Conditions of Accreditation

1. Entry to all rugby league matches under the control of the Australian Rugby League Commission Limited (ARLC) or National Rugby League Limited (NRL) including, but not limited to:

(a) all NRL Premiership matches and NRLW Premiership matches (whether played in Australia, New Zealand or elsewhere);

(b) all finals series matches (including the grand final) of the NRL Premiership and NRLW Premiership;

(c) all Representative Matches;

(d) all pre-season trial matches;

(e) any other match as determined by the ARLC from time to time, (each an Event) held in any stadium, ground, oval, or park (Venue) by an Accreditation Holder is subject to the Accreditation Conditions.

Definitions and Interpretation

2. In this document:

(a) Accreditation Holder means any person holding an Accreditation Pass on behalf of an Accreditation Organiser including, but not limited to, contractors, service providers, concessionaires, exhibitors, observers, match officials, players and media personnel.

(b) Accreditation Organiser means the person or entity granted Accreditation Passes for the Event who is represented at the Event by the Accreditation Holders.

(c) Accreditation Pass includes a Personal Accreditation Pass and/or a Generic Accreditation Pass.

(d) Accreditation Conditions means:

(i) the conditions set out in this document;

(ii) the Event Terms and Conditions (available at the Event and at https://www.nrl.com/tickets/event-terms-and-conditions/);

(iii) the NRL Spectator Code of Conduct (available at www.nrl.com/tickets/nrl-spectator-code-of-conduct/);

(iv) any conditions printed on the Accreditation Pass, including any conditions set out and agreed to on any applicable accreditation portal; and

(v) any and all reasonable directions given by officers, employees or agents of ARLC and/or NRL whether at the Event or otherwise and from time to time.

(e) Generic Accreditation Pass means an authorisation granted by ARLC and/or NRL in the form of a card that is printed with the Accreditation Organiser’s details and is accompanied by a lanyard.

(f) Personal Accreditation Pass means an authorisation granted by ARLC and/or NRL in the form of a card that is printed with the Accreditation Holder’s personal details and photograph and is accompanied by a lanyard.

(g) Representative Matches includes men’s and women’s:

(i) test matches;

(ii) State of Origin matches (including non-open age);

(iii) All Stars matches;

(iv) Pacific Championships matches; and

(v) any other match designated as such by the ARLC from time to time.

Accreditation Holders

3. Where an Accreditation Pass has been issued to an Accreditation Holder for the purpose of performing agreed duties during an Event at a Venue, the Accreditation Pass is only to be used for that purpose. For example, an Accreditation Pass must not be used to access:

(a) the relevant Venue and/or Event on days when the Accreditation Holder is not required at the Venue and/or Event to perform any agreed duties;

(b) restricted areas of the Event and/or Venue where the Accreditation Holder is not required in that area to perform agreed duties; or

(c) a Venue at times when the Accreditation Holder is not required to perform agreed duties for an Event or Events at that Venue (for example, an Accreditation Holder may be required to attend a Venue for the purposes of a NRL Premiership match (being an Event) but not for a NRLW Premiership match (also an Event) played on the same day at the same Venue).

4. Accreditation Passes, including the pass and the accompanying lanyard, must be worn visibly by the Accreditation Holder at all times while at the Venue.

5. Accreditation Holders must carry proof of identity whilst at the Venue and must present it upon request. Should an Accreditation Holder not be able to answer questions by officers, employees or agents of ARLC and/or NRL relating to the Accreditation Holder’s identity and/or purpose for being at the Event, the ARLC/NRL personnel has the right to confiscate that Accreditation Holder’s Accreditation Pass.

6. The ARLC and/or NRL may investigate the conduct of an Accreditation Holder where the ARLC and/or NRL reasonably suspects there has been a breach of the Accreditation Conditions by that Accreditation Holder. The ARLC and/or NRL may, as a result of that investigation:

(a) withdraw/cancel their Accreditation Pass for such time as the ARLC/NRL considers appropriate;

(b) suspend their Accreditation Pass for such time as the ARLC/NRL considers appropriate; or

(c) impose such conditions on their Accreditation Pass as the ARLC/NRL considers appropriate.

7. Any Accreditation Holder who is found to have breached any Accreditation Condition (whether following an investigation or otherwise) may, in addition to being liable at law:

(a) have their Accreditation Pass withdrawn;

(b) be refused entry to the Venue/Event;

(c) be directed to leave the Venue; and/or

(d) be directed to move on from a specific area of the Venue, by the ARLC or NRL.

Consumption of alcohol and/or drugs

8. The consumption of alcohol by the Accreditation Holder is strictly prohibited while at the Venue (unless otherwise permitted by the ARLC). The use of illicit drugs by the Accreditation Holder is strictly prohibited while at the Venue.

Accreditation Organiser

9. The Accreditation Organiser must:

(a) ensure Accreditation Holders comply with the Accreditation Conditions;

(b) only issue a Personal Accreditation Pass to the person whose name and photograph appears on the pass;

(c) only issue a Generic Accreditation Pass to a person who is required to attend the Event;

(d) ensure that where an Accreditation Pass has been issued to an Accreditation Holder for the purpose of performing agreed duties during, before and/or after the Event, the Accreditation Pass is only to be used for that purpose;

(e) report to the ARLC and/or NRL any suspected misuse of an Accreditation Pass by an Accreditation Holder (whether that misuse amounts to a breach of the Accreditation Conditions or not); and

(f) ensure Accreditation Holders are aware of all Accreditation Conditions.

10. The Accreditation Organiser is responsible for all acts or omissions of Accreditation Holders at the Venue, including, without limitation, any loss, damage or injury arising out of such acts or omissions. The Accreditation Organiser indemnifies ARLC in respect of any such loss, damage or injury.

11. If the Accreditation Organiser breaches any Accreditation Condition, it may have any or all of its Accreditation Passes withdrawn and/or may be otherwise liable at law.

Accreditation Passes generally

12. All Accreditation Passes remain the property of ARLC. As such, whether or not any rules and/or an Accreditation Condition has been breached:

(a) ARLC may refuse entry to the Venue to any Accreditation Holder;

(b) ARLC may direct an Accreditation Holder to leave the Venue by the nearest exit;

(c) ARLC may direct an Accreditation Holder to move on from a specific area of the Venue (notwithstanding that the Accreditation Pass may permit access to that area); and

(d) ARLC may, in its absolute discretion, require an Accreditation Holder to surrender an Accreditation Pass at any time. The Accreditation Holder or Accreditation Organiser must immediately deliver the Accreditation Pass to ARLC (and leave the Venue by the nearest exit if the surrender occurs at the Venue).

13. Where an Accreditation Pass is required to be surrendered or is withdrawn by the ARLC, the ARLC may suspend that Accreditation Pass for such time as the ARLC thinks fit (including the cancellation of that Accreditation Pass) and, accordingly, any person connected to that Accreditation Pass may be prohibited from holding any other Accreditation Pass for such time as the ARLC considers appropriate.

14. All Accreditation Passes are strictly non-transferable. Accreditation Passes may not be sold, on-sold, exchanged or otherwise transferred (including for advertising or other promotional purposes such as prizes or sweepstakes) without the prior written consent of ARLC (acting in its absolute discretion).

15. The Accreditation Organiser and Accreditation Holders must keep Accreditation Passes safe and in good condition, as ARLC is not obliged to replace any Accreditation Pass under any circumstances, including but not limited to loss or theft. The Accreditation Holder must report the loss or theft of an Accreditation Pass to the ARLC as soon as possible.

16. All Accreditation Organisers and Accreditation Holders must not photograph and/or disseminate Accreditation Passes unless required to do so for the purposes of fulfilling work duties in connection with an Event.

Accreditation applications and updating details

17. The Accreditation Organiser must submit all applications for Accreditation Passes (for the relevant Event) no later than 5pm AEST five days prior to the Event (or such other time as directed by the ARLC from time to time). This includes an obligation to provide any details as requested by the ARLC with respect to any Generic Accreditation Passes being requested by the Accreditation Organiser.

18. The Accreditation Organiser must not apply for an Accreditation Pass on behalf of an Accreditation Holder to any days of an Event where the Accreditation Holder is not required at the Event to perform agreed duties.

19. The number and type of Accreditation Passes given to the Accreditation Organiser by ARLC is at the absolute discretion of ARLC and ARLC may attach any conditions to such number and type of accreditations in its absolute discretion.

20. The Accreditation Organiser must promptly notify the ARLC and/or NRL in writing of any changes to an Accreditation Holder’s personal details.

Release

21. The risks of an Accreditation Holder being in attendance at an Event may include (but are not limited to):

(a) collision with a football, person, or other fixed or moving objects;

(b) falling on the stairs, escalators, chairs, or floors of the Venue because they are wet or have rubbish lying on them;

(c) the failure or unsuitability of facilities at the Venue (including grandstands, fences, and guard rails);

(d) being exposed to sun, rain, wind, or storm without any protection from the elements;

(e) acts of violence and other harmful acts (whether intentional or inadvertent) committed by patrons attending the Event; and

(f) being exposed to bright and flashing lights, fireworks, and loud noises.

22. By attending an Event, each Accreditation Holder may be at risk of suffering (among other things):

(a) broken bones or joint or limb injuries;

(b) blackout or fainting;

(c) burns, sunburn, cuts, and abrasions; and

(d) damage to clothes and personal equipment.

23. To the extent maximum permitted by law, the Accreditation Organiser and Accreditation Holders exclude, release and forever discharge ARLC, the NRL, and all other persons involved in the conduct, promotion and organisation of the Event (such parties to include, where relevant, all directors, officers, employees, agents, contractors and affiliated companies and their respective personnel) from all liability for claims, loss, damage, costs or expenses (whether arising under statute, from negligence, personal injury, death, property damage, infringement of third party rights or otherwise) arising from or in connection with the Event and Accreditation Passes issued under the Accreditation Conditions.

Event footage

24. Accreditation Holders must not make, create, store, record, transmit, reproduce, or use any kind of:

(a) sound recording, visual footage, or audio-visual footage (Recording) of an Event;

(b) image, including photographic images and any still pictures derived or capable of being derived from a Recording (Image) of an Event; or

(c) information or other data, including official results, performance, statistics, weather, or on-field data (Data) of, at, or in relation to an Event, for any form of public advertisement, transmission, display, or for profit or commercial gain, or for any other purpose, without the prior written consent of the ARLC or NRL.

25. If an Accreditation Holder makes, creates, records, transmits, reproduces, or uses any Recording, Image or Data of, at, or in relation to an Event (or any part of it) with or without the consent of the ARLC or NRL, the Accreditation Organisers or Accreditation Holder:

(a) must remove the Recording or Image immediately from the relevant media platform;

(b) must, on request by the ARLC or NRL assign, in writing, all copyright and all other intellectual property rights in any such Recording, Image or Data to ARLC or its assignees or nominees; and

(c) on creation, provides a perpetual, irrevocable, royalty-free license to the ARLC and NRL, and consents to the use by ARLC and any third parties authorised by the ARLC from time to time for the purposes of or in connection with any publication, exhibition, or broadcast (including any advertising and promotional material) in any media worldwide of any such Recording, Image or Data taken at an Event, including where the Recording or Image includes the Accreditation Holder, and the Accreditation Holder waives any and all of their personality and privacy rights to the extent necessary to permit such use.

Personal information

26. Accreditation Holders acknowledge that ARLC may collect and use any personal information provided by the Accreditation Organiser and/or Accreditation Holder to ARLC in accordance with the NRL Privacy Policy (available at www.nrl.com/privacy-policy/) which details how the ARLC uses and discloses personal information, how Accreditation Holders can access and/or correct their personal information, and how an Accreditation Holders can make a complaint about the NRL’s use or disclosure of personal information.

General

27. ARLC may add to, alter or otherwise vary any Accreditation Conditions without notice to Accreditation Holders or the Accreditation Organiser.

28. ARLC controls the Venue during the Event with respect to accreditation. At all times, ARLC or its representatives may with reasonable cause refuse entry to any Accreditation Holder.

29. ARLC is free to perform all of its obligations under these conditions by ensuring that NRL or any other nominated agent of ARLC performs those obligations.

30. The ARLC may, from time to time, issue directions to Accreditation Holders and/or Accreditation Organisers regarding an applicable dress code for an Event (which may include any specific identifying dress codes such as specific vests/colours etc or not wearing specific items such as Club merchandise).

31. These conditions are governed by the laws of the State of New South Wales and all persons subject to these conditions agree to irrevocably submit to the exclusive jurisdiction of courts exercising jurisdiction in New South Wales and courts of appeal from them in respect of any proceedings arising out of or in connection with these conditions.

32. Where any terms of the Accreditation Conditions are inconsistent, the conditions in this document shall prevail to the extent of the inconsistency.
